Functions of the Legal Department: 
 

  • Within the scope of its competence, drafting legal and legislative acts;
  • Conducting legal review and preparing legal opinions and/or endorsements on draft legal acts submitted by various agencies, as well as by the structural subdivisions of the Ministry and the legal entities under public law (LEPLs) within the Ministry’s system;
  • Independently or jointly with the structural subdivisions of the Ministry and LEPLs within the Ministry’s system, preparing proposals regarding the development of draft legal acts;
  • Within the scope of its competence, ensuring and/or coordinating the submission, in accordance with the procedure established by legislation, of draft legal and legislative acts prepared by the Ministry and LEPLs within its system to the Government of Georgia, the Parliament of Georgia, and other state institutions;
  • Representing the Ministry before courts of all instances;
  • Reviewing administrative complaints and applications and/or participating in their review on matters falling within the Ministry’s competence;
  • Within the scope of its competence, where necessary, participating in the preparation and/or conducting legal expertise of drafts of international and other types of agreements to be concluded by the Ministry;
  • Monitoring the performance of agreements concluded by the Ministry which, under the agreement executed between the Ministry and the LEPL – National Agency of State Property, are not subject to monitoring by the Agency;
  • Supporting and ensuring the Ministry’s legislative activities;
  • Coordinating relations between the Parliament and the Ministry in the field of legislative activities and assisting the Parliamentary Secretary of the Ministry in exercising the powers granted under the Law of Georgia “On Parliamentary Secretary”.
